Judge Fitzgerald will almost certainly deny this motion, particularly since Fitzgerald\u2019s previous written orders suggest that he believes both sides have viable cases. Rose\u2019s attorney will then present his case, with accompanying witnesses, evidence and examination by each side\u2019s attorneys.<\/p>\n<p>The four most important witnesses in the Rose trial will be these parties: Doe, Rose, Hampton and Allen. Ultimately, jurors will decide the case based on whether they find Doe\u2019s account or the three men\u2019s account more believable.<br \/>\nDoe\u2019s legal strategy<\/p>\n<p>Doe will testify first as part of the plaintiff\u2019s case-in-chief. She will retell the incident as best as she recalls. Jurors will evaluate how credible Doe seems. In making that assessment, they will likely consider how specifically and precisely Doe remembers the incident and whether her account is internally consistent. Her recollection and purpose in bringing the case will be tested on cross-examination. Rose\u2019s attorneys will try to direct her to say that her account is motivated by a desire to become a millionaire. They will highlight how frequently she and Rose engaged in consensual sex once they started dating in 2011, and they will draw attention to Doe not seeking medical attention or altering law enforcement following the alleged rape.<\/p>\n<p>After Doe testifies, her attorneys will call other witnesses to the stand. Those witnesses will include Jessica \u201cKendra\u201d Groff, Doe\u2019s friend who accompanied her to Rose\u2019s home on the night of the alleged rape. Groff is expected to testify that she and Doe consumed large amounts of tequila and other alcohol that evening\u2014this a critical point because if jurors believe Doe was very inebriated, they are more likely to believe that she could not have lawfully consented to sexual intercourse. Groff is also anticipated to testify that co-defendant Ryan Allen insisted that Groff take her clothes off while the two were at Rose\u2019s house. This point may indicate to jurors that Rose and his two friends were adamant about having sex that evening.<\/p>\n<p>Doe\u2019s roommates at that time, sisters Claudia Carleo and Marcella Carleo, are also expected to testify. Claudia Carleo was in the apartment when the alleged rape took place. She is expected to tell jurors that one of the defendants ran at her after he left Doe\u2019s bedroom and, out of fear, Carleo then locked her bedroom door to prevent him from entering. The two sisters are also expected to tell jurors that Doe described being raped in the hours after the incident.<\/p>\n<p>On cross-examination, Rose\u2019s attorneys will likely highlight how Claudia Carleo apparently did not hear any unusual noises or screams at the time of the incident (this would be a risky point for Rose\u2019s attorneys to make since if Doe was very intoxicated, she may not have been able to scream). Rose\u2019s attorneys also expect that Carleo will admit there was no damage to the apartment complex door or to Doe\u2019s apartment door, thus suggesting that perhaps the three men did not break in.<\/p>\n<p>Tommie McCaster, a co-worker of Doe at the time, is also expected to provide eyewitness testimony. He will likely tell jurors Doe was distraught after the incident. Depending on how well they testify, McCaster and other eyewitnesses could help Doe convince jurors that her account is true.<\/p>\n<p>Group sex\u2014and Doe\u2019s refusal to partake in it\u2014will be addressed in witness testimony. Doe will say that Rose repeatedly asked her to participate in group sex. At least one witness, Deanna Duncans, is expected to testify on Doe\u2019s behalf to confirm both that Rose regularly solicits group sex and that Doe always refused to partake. This is an important point because on the night of the alleged rape, Doe had sex with three men\u2014Rose, Hampton and Allen. And in this particular case, it also seems like a mischaracterization of Doe.<\/p>\n<p id=\"1168\" class=\"graf graf--p graf-after--p\">In particular, they focus on the fact that she \u201cvolunteered to bring a sex belt to have fun with Mr. Rose\u201d on August 26. While it is true that Doe mentioned a sex belt, Rose said himself in the deposition that he told her to get the belt.<\/p>\n<blockquote id=\"d1ab\" class=\"graf graf--blockquote graf-after--p\"><p><strong class=\"markup--strong markup--blockquote-strong\">Q:<\/strong> You told her to get [the sex belt]? Is that what you said?<\/p><\/blockquote>\n<blockquote id=\"6763\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Rose: <\/strong>Yeah.<\/p><\/blockquote>\n<blockquote id=\"651d\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Q:<\/strong> Okay. At one point, he even bought Doe a MacBook specifically so that she could \u201cmasturbate on Skype.\u201d<\/p>\n<p id=\"d5fd\" class=\"graf graf--p graf-after--p\">But Doe says in her deposition that she \u201ccould not get comfortable\u201d doing this, and only was able to strip down to her bra and panties.<\/p>\n<p id=\"a898\" class=\"graf graf--p graf--startsWithDoubleQuote graf-after--p\">\u201cI tried to like, reveal myself and\u200a\u2014\u200abut it was\u200a\u2014\u200ahe was annoyed by it,\u201d she said. \u201cHe was annoyed that I wasn\u2019t doing it right.\u201d<\/p>\n<p id=\"b944\" class=\"graf graf--p graf-after--p\">While there are multiple texts proving that Rose repeatedly asked for videos from Doe, she denies ever sending any, and Rose has not produced any in discovery.<\/p>\n<blockquote id=\"935f\" class=\"graf graf--blockquote graf-after--p\"><p>Defendant Rose to Plaintiff: \u201cI can\u2019t wait to get my pussy\u201d<br \/>\n(06\/20\/2013 01:06:35 PM)<br \/>\nDefendant Rose to Plaintiff: \u201cSend a video\u201d<br \/>\n(06\/20\/2013 01:31:48 PM)<br \/>\nDefendant Rose to Plaintiff: \u201cSend a video\u201d<br \/>\n(06\/20\/2013 01:32:56 PM)<br \/>\nDefendant Rose to Plaintiff: \u201cI want to see her cumin\u201d<br \/>\n(06\/20\/2013 01:38:08 PM)<br \/>\nDefendant Rose to Plaintiff: \u201cLet me know when u send it\u201d<br \/>\n(06\/20\/2013 01:43:21 PM)<br \/>\nDefendant Rose to Plaintiff: \u201cWas u able to send it\u201d<br \/>\n(06\/20\/2013 02:41:39 PM)<\/p><\/blockquote>\n<p id=\"89b0\" class=\"graf graf--p graf-after--blockquote\">After Rose and Doe had been dating for a year-and-a-half, Rose began to request she join him in group sex. But according to Rose\u2019s own deposition, prior to the night of the alleged rape, she always refused.<\/p>\n<p id=\"fdf1\" class=\"graf graf--p graf-after--p\">In fact, Rose called off the relationship with Doe earlier that summer after she refused to engage in a foursome with Rose, Randall Hampton, and Hampton\u2019s girlfriend.<\/p>\n<figure id=\"344e\" class=\"graf graf--figure graf-after--p\">\n<div class=\"aspectRatioPlaceholder is-locked\"><\/div>\n<\/figure>\n<figure id=\"344e\" class=\"graf graf--figure graf-after--p\">\n<div class=\"aspectRatioPlaceholder is-locked\">\n<div class=\"progressiveMedia js-progressiveMedia graf-image is-canvasLoaded is-imageLoaded\" draggable=\"false\" data-image-id=\"1*aHx3UCz4jXSFtPj_foR15g.jpeg\" data-width=\"451\" data-height=\"545\" data-scroll=\"native\"><img decoding=\"async\" class=\"progressiveMedia-image js-progressiveMedia-image\" src=\"https:\/\/cdn-images-1.medium.com\/max\/800\/1*aHx3UCz4jXSFtPj_foR15g.jpeg\" alt=\"\" data-src=\"https:\/\/cdn-images-1.medium.com\/max\/800\/1*aHx3UCz4jXSFtPj_foR15g.jpeg\" \/><\/div>\n<\/div><figcaption class=\"imageCaption\">An excerpt from Derrick Rose\u2019s deposition. She did, but as he clearly states, the two did not consent to group sex.<\/p>\n<blockquote id=\"d1e7\" class=\"graf graf--blockquote graf-after--p\"><p><strong class=\"markup--strong markup--blockquote-strong\">Rose:<\/strong> Oh, I wanted her to bring a friend for a threesome.<\/p><\/blockquote>\n<blockquote id=\"ef38\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Q:<\/strong> And did she?<\/p><\/blockquote>\n<blockquote id=\"c71b\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Rose:<\/strong> No. I mean, she brought her yeah.<\/p><\/blockquote>\n<blockquote id=\"ecdb\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Q: <\/strong>And did you try to have a threesome with her?<\/p><\/blockquote>\n<blockquote id=\"fb34\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Rose:<\/strong> I don\u2019t think it played out that way.<\/p><\/blockquote>\n<blockquote id=\"3d56\" class=\"graf graf--blockquote graf-after--blockquote\"><p>No, I didn\u2019t try.<\/p><\/blockquote>\n<blockquote id=\"bbb6\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Q: <\/strong>[Plaintiff] wouldn\u2019t consent to any sort of sexual activity with [her friend]; isn\u2019t that right?<\/p><\/blockquote>\n<blockquote id=\"4ecb\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Rose:<\/strong> Yeah.<\/p><\/blockquote>\n<p id=\"b73c\" class=\"graf graf--p graf-after--blockquote\">Later in the deposition, Rose flat-out denies ever having group sex with Doe, because every time he pushed the issue, she would refuse.<\/p>\n<blockquote id=\"ce76\" class=\"graf graf--blockquote graf-after--p\"><p><strong class=\"markup--strong markup--blockquote-strong\">Q: <\/strong>Have you ever had a threesome or a foursome with [Plaintiff]?<\/p><\/blockquote>\n<blockquote id=\"95a9\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Rose:<\/strong> No.<\/p><\/blockquote>\n<blockquote id=\"3fc6\" class=\"graf graf--blockquote graf-after--blockquote\"><p>\u2026<\/p><\/blockquote>\n<blockquote id=\"98f2\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Q<\/strong>: All the other times that you pushed that issue with her, she refused; isn\u2019t that right?<\/p><\/blockquote>\n<blockquote id=\"2814\" class=\"graf graf--blockquote graf-after--blockquote\"><p>\u2026<\/p><\/blockquote>\n<blockquote id=\"b780\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Rose:<\/strong> Yeah<\/p><\/blockquote>\n<h2 id=\"5deb\" class=\"graf graf--h3 graf-after--blockquote\">\u05d4\u05e9\u05d0\u05dc\u05d4 \u05d4\u05d9\u05d7\u05d9\u05d3\u05d4 \u05d4\u05d7\u05e9\u05d5\u05d1\u05d4 \u05d4\u05d9\u05d0 \u05d0\u05dd \u05d4\u05d9\u05d0 \u05d4\u05e1\u05db\u05d9\u05de\u05d4 \u05d0\u05d5 \u05dc\u05d0:<\/h2>\n<p id=\"f623\" class=\"graf graf--p graf-after--h3\">Ultimately, this is a rape case, and therefore it all comes down to whether or not Doe consented to group sex, whether or not she was even sober enough to consent to group sex, and if she wasn\u2019t sober enough, whether or not Rose and the other defendants were aware of that.<\/p>\n<p id=\"9df0\" class=\"graf graf--p graf-after--p\">As to Doe\u2019s level of inebriation on the morning in question, Rose\u2019s own expert toxicologist estimated she had a BAC level of 0.20, which is 2.5 times the legal driving limit.<\/p>\n<blockquote id=\"f5cc\" class=\"graf graf--pullquote graf--startsWithDoubleQuote graf-after--p\"><p><span class=\"markup--quote markup--pullquote-quote is-other\" data-creator-ids=\"343b8ba7c20e\">\u201cI said we men. You can assume.<\/span> Like we leaving to go over to someone\u2019s house at 1:00, there\u2019s nothing to talk\u00a0about.\u201d<\/p><\/blockquote>\n<p id=\"70c9\" class=\"graf graf--p graf-after--pullquote\">Jessica Groff, Doe\u2019s friend who was at Rose\u2019s party with her, said in her deposition that it was \u201cvery obvious\u201d Doe was intoxicated. In fact, Doe even burned her hand after she picked up rocks in the fire pit for \u201cno rational reason.\u201d<\/p>\n<p id=\"e86d\" class=\"graf graf--p graf-after--p\">After Groff allegedly had a fight with Allen that night, she decided to leave the party. However, she refused to leave Doe alone at the house.<\/p>\n<p id=\"a6d8\" class=\"graf graf--p graf--startsWithDoubleQuote graf-after--p\">\u201cI knew [Doe] was very intoxicated,\u201d Groff said in her deposition. \u201cI definitely was not going to leave her there alone. I did not feel safe and did not believe [Doe] would be safe if left alone.\u201d<\/p>\n<p id=\"1847\" class=\"graf graf--p graf-after--p\">So Groff and Doe got a cab, and Groff dropped Doe off at her apartment.<\/p>\n<p id=\"23bc\" class=\"graf graf--p graf-after--p\">Later that night, Rose inquired about whether Doe got home safely, and the two began conversing again through text message. You can assume.<\/p><\/blockquote>\n<blockquote id=\"2104\" class=\"graf graf--blockquote graf-after--blockquote\"><p><strong class=\"markup--strong markup--blockquote-strong\">Q: <\/strong>I\u2019m sorry?<\/p><\/blockquote>\n<blockquote id=\"21fe\" class=\"graf graf--blockquote graf-after--blockquote\"><p><span class=\"markup--quote markup--blockquote-quote is-other\" data-creator-ids=\"343b8ba7c20e\"><strong class=\"markup--strong markup--blockquote-strong\">Rose: <\/strong>I said we men. You can assume. Like we leaving to go over to someone\u2019s house at 1:00, there\u2019s nothing to talk about.<\/span><\/p><\/blockquote>\n<p id=\"05bf\" class=\"graf graf--p graf-after--blockquote\">However, while the defense is using Doe\u2019s texts inviting Rose over to her apartment that night as proof that she consented, Rose admitted in his deposition that nowhere in the text message did she consent or even mention group sex.<\/p>\n<blockquote id=\"45d8\" class=\"graf graf--blockquote graf-after--p\"><p>Q: All right. Is there\u200a\u2014\u200awithin what you just reviewed in those text messages, is there anything within them that would lead you to believe that plaintif wanted to have sex with you and the other two defendants on August 26th, 2013?<\/p><\/blockquote>\n<blockquote id=\"02bb\" class=\"graf graf--blockquote graf-after--blockquote\"><p>\u2026<\/p><\/blockquote>\n<blockquote id=\"95df\" class=\"graf graf--blockquote graf-after--blockquote\"><p>Rose: No.<\/p><\/blockquote>\n<h3 id=\"c1ba\" class=\"graf graf--h3 graf-after--blockquote\">The Aftermath<\/h3>\n<p id=\"100e\" class=\"graf graf--p graf-after--h3\">Doe said in her deposition that she woke up the next morning \u201cfully dressed and wet with lubricant.\u201d Her sheets were a mess and also filled with lubricant, and there was a used condom.<\/p>\n<p id=\"f7cf\" class=\"graf graf--p graf--startsWithDoubleQuote graf-after--p\">\u201cI never had my apartment that way,\u201d she said. \u201cLike that would have never happened.\u201d<\/p>\n<p id=\"f476\" class=\"graf graf--p graf-after--p\">She went to work that morning, and slowly began piecing together memories from the night of before, with an assist from Groff\u2019s text messages and her roommate. She wanted to talk to him about what happened that night.<\/p>\n<p id=\"2fae\" class=\"graf graf--p graf--startsWithDoubleQuote graf-after--p\">\u201cI didn\u2019t want\u200a\u2014\u200aI was just too\u200a\u2014\u200aI was too prideful, and I felt\u200a\u2014\u200aI didn\u2019t want to mention anything that had happened.
